Terms of Service

The short version
Use SocialWeb for lawful purposes. Don't abuse the service. Don't try to break it or harm other users. We provide the service as-is and may change or discontinue it with reasonable notice. If you break these terms, we may suspend or terminate your account.

Accepting these terms
By creating an account or using SocialWeb, you agree to these Terms of Service and our Privacy Policy. If you do not agree, do not use SocialWeb.
If you are using SocialWeb on behalf of an organization, you represent that you have authority to bind that organization to these terms.
Eligibility
You must be at least 13 years old to use SocialWeb. If you are under the age of majority in your jurisdiction, you may only use SocialWeb with the involvement and consent of a parent or legal guardian.
SocialWeb is operated from the United States. If you access it from outside the United States, you are responsible for compliance with local laws.
Your account
You are responsible for maintaining the security of your account credentials. Do not share your password. Notify us immediately at support@socialweb.cloud if you believe your account has been compromised.
You are responsible for all activity that occurs under your account. We are not liable for any loss or damage arising from your failure to maintain account security.
You may not create an account using false information, impersonate another person, or create more than one account to evade a suspension or ban.
Acceptable use
You agree not to use SocialWeb to: (a) violate any applicable law or regulation; (b) infringe the intellectual property rights of others; (c) transmit spam, malware, or other harmful content; (d) harass, threaten, or harm other users; (e) attempt to gain unauthorized access to SocialWeb's systems or other users' accounts; (f) interfere with or disrupt the integrity or performance of the service; or (g) scrape or systematically extract data from the service in violation of these terms.
We reserve the right to determine, at our sole discretion, what constitutes a violation of these terms.
Your content
SocialWeb allows you to subscribe to RSS feeds and participate in group conversations. Content you post in group conversations ("Your Content") remains yours. You grant us a limited license to store, display, and transmit Your Content solely to operate the service.
You represent that you have the rights to any content you post and that it does not violate these terms or applicable law.
We do not pre-screen content but reserve the right to remove content that violates these terms, applicable law, or that we reasonably believe poses a risk to users or the service.
Self-hosted instances: content on self-hosted instances is entirely outside our control and responsibility.
Subscriptions and billing
SocialWeb offers a free tier and paid subscription plans. Paid features require an active subscription.
Billing is handled by our payment processor. {{TODO: payment processor — add name before launch.}} You authorize us to charge your payment method on a recurring basis for the subscription period you select.
You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period. We do not provide refunds for partial periods unless required by applicable law.
We may change subscription prices with at least 30 days' notice. Continued use after the price change takes effect constitutes acceptance of the new price.
Free trial

Copyright and DMCA
We respect intellectual property rights. If you believe that content on SocialWeb infringes your copyright, please send a notice to support@socialweb.cloud with: (a) a description of the copyrighted work; (b) a description of where the allegedly infringing material is located; (c) your contact information; (d) a statement that you have a good-faith belief that the use is unauthorized; and (e) a statement, under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act on their behalf.
Self-hosting
SocialWeb's server software is open source. You may run your own instance subject to the terms of the applicable open source license. These Terms of Service govern use of the managed cloud service (socialweb.cloud); they do not restrict your rights under the open source license.
We do not provide support, uptime guarantees, or data backups for self-hosted instances.
Disclaimer of warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.
Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, SOCIAL WEB CLOUD LLC AND ITS OFFICERS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR DATA, ARISING OUT OF OR IN CONNECTION WITH THESE TERMS OR YOUR USE OF THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE MONTHS PRECEDING THE CLAIM, OR USD $100, WHICHEVER IS GREATER.
Indemnification
You agree to indemnify and hold harmless Social Web Cloud LLC and its officers, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or in any way connected with your use of the service, your violation of these terms, or your violation of any rights of another.
Termination
You may delete your account at any time. We will delete your data within 30 days, subject to legal holds.
We may suspend or terminate your account if you violate these terms, if we are required to do so by law, or if we decide to discontinue the service. We will provide reasonable notice where practicable, except in cases of serious violations.
On termination, your right to use the service ends immediately. Sections that by their nature should survive termination (including limitation of liability, indemnification, and dispute resolution) will survive.
Governing law and disputes
These terms are governed by the laws of the State of Oregon, USA, without regard to its conflict-of-laws principles.

Any dispute not resolved informally will be brought exclusively in the state or federal courts located in Oregon, and you consent to personal jurisdiction in those courts.
Changes to these terms
We may update these terms from time to time. If we make material changes, we will notify you by email and update the effective date at the top of this page. Your continued use of SocialWeb after the effective date constitutes acceptance of the updated terms.
If you disagree with the updated terms, you may delete your account before the effective date.
